Transparency matters. Below you’ll find the policies and terms that apply when using the MR Creative website or working with MR Creative. Select a section to review the applicable information.

These Terms & Conditions (“Terms”) govern use of the MR Creative website and services offered by MR Creative. By using this website, submitting an inquiry or application, purchasing services, or entering into a service relationship with MR Creative, you agree to these Terms where applicable.

If you enter into a separate written agreement, proposal, or contract with MR Creative and its terms conflict with these Terms, the terms of the signed agreement will control for that service.

1. Services

MR Creative provides services that may include website design and development, website maintenance, hosting, e-commerce development, automation, integrations, social media and content services, consulting, and other digital or small-business services.

Specific services, pricing, timelines, deliverables, and responsibilities may be established through a proposal, service agreement, statement of work, invoice, or other written agreement.

Submission of an inquiry, application, or contact form does not guarantee acceptance of a project or create a service relationship.

MR Creative reserves the right to decline projects or services at its discretion, subject to applicable law.

2. Pricing and Payment

Pricing displayed on the MR Creative website reflects current offerings and may change at any time.

Pricing changes will not retroactively change amounts already established in a signed agreement unless otherwise permitted by that agreement or agreed to by the parties.

Clients are responsible for paying invoices and recurring charges according to the applicable agreement or payment schedule.

Additional services requested outside an agreed scope may result in additional charges. MR Creative will obtain approval before performing additional billable work unless otherwise authorized by an applicable agreement.

3. MR Creative Monthly

MR Creative Monthly is an ongoing website service that combines website design and development with hosting, maintenance, support, updates, and other services according to the selected plan.

MR Creative Monthly plans require an initial 12-month commitment unless otherwise expressly stated in writing.

Specific plan pricing, included services, Website Build Value, ownership terms, early-termination provisions, and other requirements are established in the applicable MR Creative Monthly Website Services Agreement.

Completion of an application for MR Creative Monthly does not create a contractual relationship. Services begin only after MR Creative accepts the project and any required agreement and initial payment have been completed.

4. Client Responsibilities

Clients are responsible for providing accurate and timely information necessary for MR Creative to perform requested services.

This may include:

  • business information;
  • website copy;
  • photographs and graphics;
  • branding materials;
  • products and pricing;
  • account credentials;
  • platform access;
  • approvals and feedback; and
  • other reasonably requested materials.

Clients are responsible for ensuring that materials they provide may legally be used.

Delays in providing requested information, materials, approvals, or access may delay completion of services.

5. Intellectual Property

Clients retain ownership of materials they owned before providing them to MR Creative, including their business names, trademarks, logos, photographs, written content, and other pre-existing intellectual property.

Ownership of work created by MR Creative depends upon the applicable service agreement and payment terms.

Unless otherwise agreed in writing, MR Creative retains ownership of its reusable and pre-existing intellectual property, including templates, frameworks, code libraries, processes, systems, workflows, tools, techniques, and know-how.

Clients may not copy, resell, sublicense, distribute, or commercially exploit MR Creative’s proprietary materials independently from the work for which appropriate usage rights have been granted.

6. Third-Party Products and Services

MR Creative may use or recommend third-party products and services in connection with client projects.

Examples include hosting providers, domain registrars, payment processors, website plugins, applications, software platforms, APIs, booking systems, e-commerce tools, email services, and other integrations.

Unless expressly stated otherwise in writing, clients are responsible for applicable third-party costs, including monthly subscriptions, annual renewals, usage fees, transaction fees, and licensing fees.

MR Creative does not control third-party providers and cannot guarantee their continued availability, pricing, functionality, security, compatibility, or policies.

7. Domains

When MR Creative assists with domain registration or management, applicable domain registration and renewal charges remain the client’s responsibility unless expressly agreed otherwise.

Domain pricing is determined by the applicable registrar or provider and may change.

Ownership and transfer of a client-specific domain are governed by the applicable service agreement and registrar requirements.

8. Project Timelines

Any estimated completion or launch date depends upon timely client participation and circumstances reasonably within MR Creative’s control.

Client delays, third-party outages, scope changes, delayed approvals, technical complications, or circumstances outside MR Creative’s reasonable control may affect project timelines.

Unless expressly guaranteed in writing, estimated completion dates are not guarantees.

9. Website Updates and Additional Work

Where ongoing website updates or support are included in a service plan, those services are limited to the applicable plan allowance and agreed scope.

Unused monthly service time does not roll over and has no cash value unless expressly stated otherwise.

Requests outside the included scope may be quoted separately or billed according to MR Creative’s then-current additional-work rate with client approval.

10. Refunds and Cancellations

Refunds, cancellations, early termination, and related matters are governed by MR Creative’s Refund & Cancellation Policy and any applicable signed agreement.

When a signed service agreement contains different or more specific provisions, the signed agreement controls.

11. Portfolio Use

Unless otherwise agreed in writing, MR Creative may display completed client work and publicly available project information in its portfolio, website, social media, proposals, case studies, and promotional materials.

Clients may request in writing that MR Creative refrain from future promotional use of their project.

MR Creative will not intentionally publish confidential client information, passwords, private customer data, or other non-public sensitive information for promotional purposes.

12. Website Information

MR Creative makes reasonable efforts to keep information on its website accurate and current.

However, website information may occasionally contain errors, outdated information, typographical mistakes, or incomplete information.

MR Creative may update website content, pricing, service descriptions, policies, and offerings as needed.

13. No Guaranteed Results

MR Creative does not guarantee specific business results from any website, marketing, automation, social media, SEO, or other service.

This includes guarantees concerning:

  • search-engine rankings;
  • website traffic;
  • leads;
  • sales;
  • revenue;
  • customer acquisition;
  • conversion rates; or
  • social-media reach or engagement.

Results depend upon numerous factors outside MR Creative’s control.

14. Prohibited Use

You may not use the MR Creative website or services to:

  • violate applicable law;
  • infringe another party’s intellectual-property rights;
  • distribute malware or malicious code;
  • attempt unauthorized access to systems or accounts;
  • engage in fraudulent or deceptive activity;
  • interfere with website security or operation; or
  • misuse MR Creative’s content, branding, systems, or intellectual property.

MR Creative may refuse or discontinue services involving unlawful, fraudulent, abusive, or materially harmful activity.

15. Disclaimer of Warranties

MR Creative will perform contracted services in a professional manner.

Except for warranties expressly provided in a signed agreement and to the fullest extent permitted by applicable law, the MR Creative website and services are otherwise provided on an “as is” and “as available” basis.

MR Creative does not guarantee uninterrupted availability or compatibility with every device, browser, platform, third-party product, or future technology.

16. Limitation of Liability

To the fullest extent permitted by applicable law, MR Creative will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the MR Creative website or services.

Any additional limitations applicable to paid client services are established in the applicable service agreement.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

17. Privacy

Information submitted through the MR Creative website is handled according to the MR Creative Privacy Policy.

Clients should not submit passwords, financial information, confidential customer information, or other sensitive information through ordinary website contact forms unless specifically instructed to do so through an appropriate secure method.

18. Changes to These Terms

MR Creative may update these Terms from time to time to reflect changes in services, business practices, technology, or applicable requirements.

The “Last Updated” date will be revised when these Terms are materially updated.

Changes to these public Terms do not retroactively alter a signed client agreement unless permitted by that agreement, agreed to by the parties, or required by law.

19. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

Specific dispute and venue provisions applicable to paid client services may be contained in the applicable service agreement.

MR Creative is committed to being transparent about payments, cancellations, and refunds. Because many of our services involve custom work, reserved service time, digital products, hosting, and ongoing support, the following policies apply unless otherwise stated in a signed agreement or proposal.

MR Creative Monthly

MR Creative Monthly combines professional website design and development with ongoing hosting, maintenance, support, and updates for a recurring monthly fee.

MR Creative Monthly plans require an initial 12-month commitment. The specific monthly fee, website scope, included services, and standalone Website Build Value are established before services begin and are included in the client’s service agreement.

Monthly Payments

Monthly payments are non-refundable once the applicable monthly service period has begun.

Monthly fees cover a combination of website development and ongoing services, including hosting, maintenance, security, support, and updates according to the client’s selected plan.

Unused monthly support or update time:

  • does not roll over to future months;
  • cannot be exchanged for cash or account credit; and
  • is non-refundable.

Cancellation During the Initial 12-Month Term

Clients may request cancellation before completing the initial 12-month term.

MR Creative does not require clients who cancel early to automatically pay every remaining monthly payment under the 12-month agreement.

Instead, an Early Termination Buyout may apply based on the unpaid portion of the website’s agreed standalone Build Value.

For purposes of calculating the buyout, 100% of regular MR Creative Monthly plan payments actually received during the initial term are credited toward the agreed Website Build Value.

For example, if a website has an agreed Build Value of $1,500 and the client has made three regular monthly payments of $299:

$1,500 Build Value − $897 in qualifying payments = $603 Early Termination Buyout

Add-on services, domain fees, third-party expenses, additional billable work, taxes, late fees, transfer fees, and other charges outside the regular monthly plan fee do not count toward the Website Build Value.

The Early Termination Buyout will never exceed the unpaid portion of the agreed Website Build Value.

Website Ownership After Early Cancellation

Clients who cancel during the initial term are not required to purchase the website.

If the applicable Early Termination Buyout and all other outstanding amounts are paid, the client may receive ownership of the completed website work in accordance with their service agreement.

If the client chooses not to pay the applicable buyout, MR Creative retains ownership of the website and may discontinue hosting and website services following applicable notice requirements.

Previously paid amounts are not refunded.

Cancellation After the Initial 12 Months

After the initial 12-month commitment has been completed and all required payments have been made, the client owns the completed client-specific website work as described in the service agreement.

Clients may choose to:

continue their existing service plan, if available;

move to an available MR Creative Continued Care plan;

select another available support arrangement; or

take over management of their website independently.

Continued Care pricing and service offerings may change over time. Current pricing will be provided before a new or renewed service period begins.

Third-Party Services and Expenses

Fees charged by third parties are generally non-refundable and are subject to the individual provider’s policies.

These may include plugins, software licenses, applications, payment processors, premium integrations, subscriptions, hosting-related upgrades, and other third-party services.

Clients are responsible for recurring monthly or annual third-party expenses associated with their website unless MR Creative expressly agrees otherwise in writing.

Domain registration and renewal costs are also the client’s responsibility and are based on the rates charged by the applicable domain registrar or provider.

Custom Projects and Additional Services

Deposits, retainers, setup fees, and payments for custom work outside MR Creative Monthly may have separate cancellation and refund terms stated in the applicable proposal, invoice, or service agreement.

Once custom work has begun, amounts paid for completed work, reserved project time, purchased resources, or incurred expenses are generally non-refundable.

If a separate signed agreement contains different refund or cancellation terms, the signed agreement controls.

Hardship and Extraordinary Circumstances

MR Creative understands that unexpected situations happen.

Clients experiencing circumstances such as serious illness, disability, natural disaster, unexpected business closure, or another significant hardship are encouraged to contact MR Creative.

MR Creative may, at its discretion, work with a client to modify, reduce, defer, or waive certain obligations when appropriate.

Any exception or accommodation must be agreed to in writing and does not modify the general policy for other clients.

Chargebacks and Payment Disputes

Clients who believe a charge was made incorrectly are encouraged to contact MR Creative before initiating a chargeback or payment dispute so that we have an opportunity to investigate and resolve the issue.

Nothing in this policy limits any rights available to a client under applicable law or through their financial institution.

Changes to This Policy

MR Creative may update this Refund & Cancellation Policy from time to time. Changes will apply prospectively and will not override the terms of an existing signed agreement unless both parties agree otherwise or applicable law requires the change.

MR Creative does not sell personal information to advertisers or data brokers.

Information submitted through MR Creative inquiry, application, onboarding, or other website forms may be transmitted to or stored within third-party systems used to manage client relationships and projects.

Submitting an inquiry or application does not guarantee acceptance of a project or create a contractual relationship.

Please do not submit highly sensitive information, passwords, government identification numbers, financial-account credentials, medical information, or other unnecessary sensitive data through ordinary website forms.

5. Client Portal and Project Management

MR Creative may use third-party client-management and project-management systems to organize client information, proposals, contracts, invoices, project communications, files, tasks, and other service-related information.

Clients may receive access to a secure client portal for managing aspects of their relationship with MR Creative.

Clients are responsible for maintaining the confidentiality of their login credentials and should notify MR Creative if they believe their account or credentials have been compromised.

6. Payment Information

MR Creative may use third-party payment processors to collect and process payments.

MR Creative generally does not directly store complete credit or debit card numbers when payments are processed through a third-party payment provider.

Payment providers may collect billing information and payment credentials according to their own privacy policies and security practices.

MR Creative may retain transaction information such as payment status, amount, date, invoice information, and other records necessary for accounting and client management.

7. Cookies and Similar Technologies

The MR Creative website may use cookies or similar technologies necessary for website operation, security, functionality, analytics, or user experience.

Third-party tools incorporated into the website may also use cookies or similar technologies.

Opting out of promotional emails does not prevent MR Creative from sending necessary transactional or service-related communications.

MR Creative may share information with service providers when reasonably necessary to operate the business or provide services.

These providers may include:

  • website hosting providers;
  • domain registrars;
  • client-management or project-management platforms;
  • form providers;
  • payment processors;

  • software and plugin providers;
  • contractors assisting with an authorized client project; and
  • professional advisers such as accountants or attorneys.

MR Creative does not authorize service providers to use information for unrelated purposes beyond their own applicable terms and lawful business practices.

Information may also be disclosed when reasonably necessary to comply with law, respond to lawful legal process, prevent fraud or abuse, enforce agreements, or protect the rights or safety of MR Creative or others.

11. Third-Party Websites and Services

MR Creative does not control the privacy practices, security, content, or policies of independent third-party websites and services.

However, no website, internet transmission, cloud service, software platform, or electronic storage method can be guaranteed completely secure.

13. Data Retention

MR Creative may retain information for as long as reasonably necessary to:

  • provide services;
  • maintain client and project records;
  • complete transactions;
  • comply with tax, accounting, contractual, or legal obligations;
  • resolve disputes;

Information that is no longer reasonably necessary may be deleted, anonymized, or archived as appropriate.

14. Children’s Privacy

MR Creative’s website and services are intended for businesses and individuals seeking professional digital services and are not directed toward children under 13.

MR Creative does not knowingly seek to collect personal information from children under 13 through its website.

If MR Creative becomes aware that personal information from a child under 13 has been collected without appropriate authorization, reasonable steps will be taken to delete it.

15. Your Privacy Requests

You may contact MR Creative to request information about personal information maintained about you or to request correction or deletion of information, where appropriate and subject to applicable legal, contractual, tax, accounting, or recordkeeping obligations.

MR Creative may need to verify your identity before completing certain privacy requests.

Some information may need to be retained even after a deletion request when necessary to comply with legal obligations, maintain transaction records, resolve disputes, or enforce agreements.

16. Business Transfers

If MR Creative is sold, merged, reorganized, or transfers all or part of its business, information associated with the business may be transferred as part of that transaction, subject to applicable law.

17. Changes to This Privacy Policy

MR Creative may update this Privacy Policy as business practices, technologies, services, or legal requirements change.

The “Last Updated” date at the top of this Policy will be updated when material changes are made.
